Car rental terms and conditions
CONTRACT CONDITIONS Please read carefully the clauses marked with an asterisk (*).
1. Vehicle Conditions: The vehicle will be delivered clean, odor-free, and without visible damage. A check of the vehicle's condition will be conducted at the time of delivery. The lessee must return it in the same condition.
2. Vehicle Delivery: THE LESSOR provides the CLIENT, who signs the contract, and the authorized additional drivers, referred to as LESSEES, with a vehicle owned by them, described at the front of this contract, in optimal mechanical, body, and paint condition, along with the equipment and accessories detailed on the check-out sheet.
3. Duration of the Agreement: The agreement begins on the date of signature and may be extended by mutual consent. The terms are voluntary for THE LESSOR and mandatory for the LESSEES, who commit to comply with the timeframe specified in the "RETURN DATE" box. Upon the expiration of this term, unless otherwise indicated, the vehicle must be returned to the same office where the contract was signed or to another office designated by THE LESSOR. THE LESSOR reserves the right to collect the vehicle at any location and time deemed appropriate, without prior notice.
4. Lessee Responsibilities: Speeding: Adhere to speed limits to avoid fines. Overtaking: Overtake only in authorized zones. No Smoking Policy: Smoking inside the vehicle is prohibited; violation may result in cleaning charges. Parking: Park only in permitted areas, preferably in private parking lots for the safety of your belongings. Avoid yellow-lined zones to prevent additional costs associated with lost plates, which can vary by location (minimum cost $500 USD). Key Care: Safeguard the keys; in case of loss, cover the costs of transportation and replacement ($500 USD for electronic keys). Driving Restrictions: Drive only on suitable roads; insurance does not cover damages from misuse. Fuel: The vehicle must be returned with the same fuel level it was delivered with. The client must use the type of fuel specified on the fuel cap. If the vehicle is returned with less fuel, an additional charge will be applied for each ⅛ tank missing ($15) along with a service fee of $20. Using an incorrect fuel type will make the client responsible for any resulting damage.
5. Lessor Obligations: Basic Insurance: The vehicle comes with mandatory insurance with a fixed deductible of $1200, regardless of fault in the accident. Damages from $1 to $1200 will be covered by the client. In case of theft, the lessee must pay at least $2500. The insurance does not cover glass, tires, or minor damages below the deductible, nor damages incurred while under the influence of alcohol or drugs. You may opt to purchase additional zero deductible or full coverage insurance for added peace of mind. In case of an accident, the lessee agrees not to move the vehicle and to notify the lessor immediately, in addition to calling the corresponding insurance company (800-800-8000) INS.
6. Liability for Damages: The LESSEES must pay THE LESSOR for the replacement or repair of all damages caused to the vehicle, its equipment, and accessories during the rental period, regardless of who is at fault. If the LESSEE accepts the Loss Damage Waiver (LDW) when signing the contract, THE LESSOR waives the right to charge the total amount of damages up to the maximum amount stipulated on the back of the contract, provided that the LESSEES comply with the established terms. If the damages result from a violation of any clause of the contract, the LDW will be voided and all damages will be chargeable to the LESSEE. It is important to note that the LDW does not cover theft or the cost of daily rental until the vehicle is repaired and returned to the rental fleet.
7. Commitments of the Lessees: The LESSEES commit to: Not driving under the influence of alcohol or drugs. Taking care of the vehicle as if it were their own, conducting daily checks of fuel, oil, and general conditions. Respecting traffic signs and regulations set by authorities. Not taking the vehicle out of the country. Always carrying their valid driver’s license and identification documents, as well as keeping the vehicle papers and a copy of the contract at all times. Notifying THE LESSOR immediately in case of an accident or incident.
8. Responsibilities of the Lessees: They will be responsible for: Damages caused to the vehicle and its equipment or accessories while in their possession. Damages suffered by themselves and other occupants of the vehicle. Bodily injury damages caused to third parties and their property. Monetary penalties imposed for traffic law violations, including legal and administrative costs necessary for the recovery of the property. Not smoking inside the vehicle, which may incur extra cleaning costs, as the next lessee may not tolerate the smell of tobacco. 9. Accident Liability: In the event of an accident, the LESSEES are responsible for paying THE LESSOR: a) All sums that THE LESSOR has had to disburse, judicially or extrajudicially, for these concepts, plus expenses, fees, costs, and other related charges. b) The daily rental amount at the prevailing rate while the vehicle remains out of service or under repair, as well as the costs of its release.
10. Insurance Coverage: If the LESSEES have insurance that becomes inapplicable for reasons attributable to them, they must immediately pay any uncovered liability, along with associated expenses, fees, and costs. If the event is covered by the policy, the LESSEES must pay the deductible and other applicable deductions; if the damage does not exceed the deductible amount, this will be the responsibility of the LESSEES. Insurance does not cover damage to windshields or windows of the vehicle. Damages from $1 to $1200 are the client's responsibility, regardless of fault in the incident.
11. Waiver of Right: The product offered is not insurance, but a waiver of THE LESSOR's right to charge the LESSEES for direct or indirect damages. This waiver does not apply in cases of violation of the terms and conditions of the contract.
12. Security Deposit: By signing this contract, the LESSEES provide THE LESSOR with the amount indicated in the "Deposits" section as a guarantee for compliance with the terms of the contract and the care of the rented vehicle. THE LESSOR may deduct from this amount any sums owed by the LESSEES, who remain responsible for any remaining balance.
13. Compliance with the Contract: The LESSEES are obligated to strictly comply with all stipulations and commitments of this contract. Non-compliance will result in corresponding civil and criminal actions, as well as the possibility of indemnities.
14. Termination of the Agreement: Either party may terminate the contract with 24 hours' notice, except during peak season or if the vehicle already has a new rental. Non-compliance allows the lessor to terminate the contract immediately.
15. Jurisdiction: The parties submit to the jurisdiction of the courts of Alajuela, waiving any jurisdiction that may apply to them. Both parties submit to the jurisdiction of the judges of Costa Rica.
16. Refund Policy: There will be no refund for unused time. Insurance does not cover damages to the underside of the vehicle. In case of lost plates, the LESSEE will pay $500 and administrative expenses; the insurance also does not cover the loss of keys, and the LESSEE will assume this cost (500USD) and and assistance to the place THE LESSOR is not responsible for lost or left items in the vehicle.
Authorization: I authorize CBX Rent a Car to use the security deposit to cover any damages that may arise during the rental period of this contract. I have read and accepted the terms and conditions of the vehicle rental both on this page and on the back of this document.
